Terms of Service

Welcome to ManaWell. By accessing or using this platform, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use ManaWell.

1. Who We Are

ManaWell is a volunteer-run, community-funded platform that connects donors with recipients in the game development community who are experiencing financial hardship. We are not a nonprofit, charity, or financial institution. We charge a 5% fee on each purchase to cover development, hosting, and operational costs.

2. Eligibility and Accounts

You must be at least 18 years old to use ManaWell. Donors may browse and check out without creating an account. Recipients must create an account using a valid referral code issued by ManaWell. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate, complete information when creating an account. ManaWell reserves the right to suspend or terminate accounts that provide false information or violate these terms.

3. Platform Use

ManaWell is intended solely for its stated purpose: enabling donors to purchase items from recipients' Vitals Lists. You may not use the platform to:

  • Post fraudulent, misleading, or inaccurate needs
  • Circumvent the platform to conduct off-platform transactions
  • Harass, threaten, or harm other users
  • Scrape, reverse-engineer, or abuse platform systems
  • Use the platform for any unlawful purpose

4. Purchases and Fees

When you complete a purchase, you pay the retail price of the item, applicable shipping charges, and a 5% ManaWell service fee. Payments are processed by Rye, our third-party checkout provider. ManaWell does not store payment card data.

Items ship directly from retailers to recipients. Pending or processing orders may be cancelled within 30 minutes of purchase. Once shipped, returns are subject to the individual retailer's return policy. ManaWell does not guarantee delivery and is not liable for retailer or carrier errors.

5. Recipient Responsibilities

Recipients represent that the information on their profile and Vitals List is truthful and accurate. Submitting false hardship claims or misrepresenting your situation is a violation of these terms and may result in permanent account termination.

Recipients are responsible for keeping their shipping address current and encrypted within the platform. ManaWell is not responsible for failed deliveries caused by an incorrect or outdated address.

6. Privacy

Your use of ManaWell is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the platform, you consent to the data practices described in that policy.

7. Intellectual Property

All platform content, design, and code are the property of ManaWell or its contributors. You may not reproduce, distribute, or create derivative works without express written permission. User-submitted content (bios, hardship notes, support letters) remains your property; by submitting it you grant ManaWell a non-exclusive, royalty-free license to display it on the platform.

8. Disclaimers

ManaWell is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not verify the identity of recipients beyond the referral code requirement.

9. Limitation of Liability

To the fullest extent permitted by applicable law, ManaWell and its contributors will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim will not exceed the amount you paid in fees to ManaWell in the 90 days preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of ManaWell after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved through good-faith negotiation first. If that fails, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association.
